DOWN PAYMENTS; a 25% down payment is mandatory when booking 8+passenger vans, buses, 23+ passenger mini-buses and stretch limousines. Sedan and SUV orders do not require down payments unless directed by Second City Livery Service. TOLLS; Based on traffic, weather and road conditions of the day, your driver will make a determination of the safest and fastest route to your destination. He may occasionally opt to take a toll route over a free route based on his knowledge and experience. Passengers are responsible for any tolls incurred throughout the trip. You will be charged the full toll rate. Discounted rates do not apply. Upon arrival at your destination, the driver will inform you of the tolls and add them to your bill. Tolls may vary from trip to trip based upon the route taken. Round trip tolls will be charged on trips where the driver cannot return to his or her destination without paying a toll. When traveling in a Sedan, Luxury Sedan, SUV, 8+ passenger vans, buses, 23+ passenger mini-buses and stretch limousines a mandatory gratuity of 20% will apply. WAITING TIME; Waiting time is based on the hourly rate for a particular vehicle and is charged at 15 minute increments. Waiting time charges may be incurred if a passenger arrives late to a pick-up. Time spent waiting at additional stops will also be charged as waiting time. Waiting time charges may apply after the complimentary waiting time expires on a round-trip.We do not charge waiting time attributed to delayed flights or luggage delivery for pick-ups at the airport. PEAK HOURS; When booking a reservation to be picked up Monday-Friday between the hours of 6:00am-9:00am and/or 3:00pm-6:00pm there will be an additional $10.00 fee added to your fare. If booking a reservation for Saturday or Sunday between the hours of 12:00am-4:00am there will be an additional $15.00 fee added to your fare. ADDITIONAL STOPS; The fare quoted online does not include any additional stops made during your trip. Unless specifically discussed, when booking a reservation by phone, the fare quoted by an operator does not include additional stops. Additional stops for sedans and SUV’s are $10.00 per stop and $15.00 per stop for vans, buses, mini-buses and limousines. HOURLY CHARTERS; when booking a reservation for an hourly charter, the prices reflect a 20 mile limit per hour to the vehicle you have chosen. Any miles over your limitation will be billed at $1.00 per mile for sedans and $2.00 a mile for SUV’s. (Ex. If you book a vehicle for 5 hours, you will be allowed 100 miles during that time frame. If you end up traveling 120 miles, there will be an additional $20.00 charge for a sedan and a $40.00 charge for an SUV). LONG DISTANCE CHARTERS; If you request a long distance charter, the same mileage rules apply similar to the hourly charters. Second City Livery Service will not be responsible for your drivers return fees, mileage, tolls, etc. if you decide to take a long trip and be dropped off. (Ex. You take a 200 mile trip to a sporting event and then decide you want to stay there for a few days to visit friends and family or you simply decide to fly back or any other excuse. You will be charged accordingly for the tolls and 200 miles your driver has to drive to get back home). AIRPORT FEES & PARKING FEES; When booking a reservation from Midway or O’Hare Airports, airport fees will be added to the fare. The airport fees and/or parking fees are based upon the parking rates and fees issued by the City of Chicago. Currently, the City of Chicago charges all Taxi and Livery drivers $4.00 when entering the airports to pick up their passengers. CANCELLATIONS; You will not be charged for a sedan or SUV order if you cancel your trip at least 24 hours before your pick up. Your credit card will be charged 25% of the total fare amount if your trip is not canceled at least 24 hours in advance to your originally scheduled pick up. Your credit card will be charged the FULL value of your fare if you cancel within 3 hours of your scheduled pick up. Cancellations for passenger vans, buses, mini-buses and stretch limousines must be cancelled at least 7 days before your trip. If you do not cancel at least 7 days in advance your 25% deposit will be non-refundable. In order to avoid cancellation fees, customers must notify a customer service representative of a cancellation at least 24 hours in advance for a sedan or SUV and at least 7 days for passenger vans, buses, mini-buses and stretch limousines. RATES AND BILLING; All rates are subject to audit after order completion. Occasionally changes must be made to correct mathematical errors or to reflect the actual tolls, parking fees, additional stops and waiting time. Second City Livery Service rates are inclusive of taxes. AFFILIATE SERVICE POLICY; Second City Livery Service utilizes, at its discretion, affiliates to provide Limousine and Ground Transportation services as requested by our clients. VEHICLE IMAGES; Vehicle images presented on the Second City Livery Service website may differ from the actual vehicle. LOST OR DAMAGED ITEMS; Second City Livery Service and its Affiliates are not responsible for lost or damaged items left in the vehicles. We make every effort to locate property that has been left in one of our vehicles. We retain found items for 30 days. If you have left a personal item in one of our vehicles and wish to retrieve it, you may call our office at (312) 448-8787 for our support team or email us at email@example.com. Second City Livery Service reserves the right to charge a delivery fee for returning found items. These fees are based on the full travel rates. EXCLUSIONS AND LIMITATIONS OF LIABILITY; Second City Livery Service and its Affiliates are not responsible for missed flights, abandoned plans or losses incurred due to circumstances that are beyond our control. These circumstances include but are not limited to, causes beyond its reasonable control, acts of God and Nature, acts of terrorism, travel congestion, road closures, accidents, flight and weather delays. Second City Livery Services’ liability for all causes whatsoever arising shall be limited to your actual damages, in an amount not to exceed the sum of all charges paid by you for the fare.
SECOND CITY LIVERY SERVICE SHALL HAVE NO LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT OR OTHERWISE FOR CONSEQUENTIAL, EXEMPLARY, SPECIAL, INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION OR CLAIMS IN THE AGGREGATE, INCLUDING WITHOUT LIMITATION BREACH OF CONTRACT, BREACH OF WARRANTY, INDEMNITY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND OTHER TORTS. YOU AND SECOND CITY LIVERY SERVICE EACH UNDERSTAND AND AGREE THAT THESE REMEDIES, EXCLUSIONS AND LIMITATIONS ALLOCATE THE RISKS OF SERVICE NON-CONFORMITY AS AUTHORIZED BY THE UNIFORM COMMERCIAL CODE AND/OR OTHER APPLICABLE LAWS. SECOND CITY LIVERY SERVICES’ FARES FOR SERVICES REFLECT, AND ARE SET IN RELIANCE UPON, THIS ALLOCATION OF RISK AND THE EXCLUSION OF CONSEQUENTIAL DAMAGES AND LIMITATIONS OF LIABILITY SET FORTH IN THIS AGREEMENT. THE FOREGOING LIMITATIONS OF LIABILITY APPLY WITHOUT REGARD TO ANY INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE BY SECOND CITY LIVERY SERVICE.
